The Superior Court of Appeals has ordered U.S. paralyze the process by which MGA Entertainment should withdraw from the market before January 21, 2010 all Bratz products. Pending a final resolution to figure out who should keep the rights, may be disposed of Bratz dolls.
The conflict dates back to 2001, when Bratz came on the market to compete with Mattel's Barbie. The multinational MGA sued claiming the Bratz name and design came from the drawings of one of his employees while he was still working in his company.
After four years of litigation, a federal court ruled in favor of Mattel, MGA Entertainment so that should compensate them with a hundred million dollars for violation of his patent. On the other hand, was ordered off the market all the Bratz dolls before 21 January 2010. Now, after the new court, the order has been suspended pending a final decision as reported yesterday in a press release.
The director of marketing for MGA Entertainment Iberia, Jorge Arceo, concurred with the ruling, maintaining that "businesses of all kinds worldwide can and should continue promoting and selling Bratz any product in its power."
